Two days of hell...

Tues. night I was out speeding to the burrito place and my buddy was a ways behind me. The police pull us over, say it was a speed contest, and impounded both our cars. WTF! :eek:
All day Wednesday we got the run around between the P.D. and the courts on how to get them out. The more I researched impound laws and statutes the worse things looked. :cry:
Today we had a tow hearing with the P.D. and they released our cars. We're both in our 30's, clean driving records, married, homeowners, etc. I think they know we're not street racers.
So the past two days I've been feeling like crap, all stressed our and stuff. I hate the fact that they had my car.
Becareful out there fella's the cops aren't playing anymore. Now I need to get these charges dropped.

P.S.
Go stealth route with the mods. When they searched the cars they couldn't find a single thing wrong with mine. They had a field day with my friends and now he has to go to a state referee. :thumbdown

How fast were you going? I got pulled over for speed contest, and illlegal manuvers in my GTI and drove home. (then got off later as the cop never showed up. ;) ) But best of luck, sorry to hear you had your car took away from you for a little while. Next time your around my way I will buy you a beer. :thumb:

But to call it a speed contest... when my friend's following me 1/4 mile back... come on.
That still should not have warrented a impounding of your car. You have to be doing over 100mph (in MD atleast) to have your car towed. As for the speed contest I think the cop was thinking you were just really killing the other guy in the race. :thumb:

Most places consider more than 30 mph over the posted limit reckless driving and it is a mandetory impound in most areas on reckless driving charges.

yea it is getting bad... i get followed around even if im doing the speed limit... :thumbdown
I forgot to mention that they released the car 48 hous later. I did a little research and found out that if the charges are dropped, the impounding agency is liable for the impound fees. I have a feeling the Sgt. reveiwng the impound did not want the department to eat a $1000 impound bill so she released the cars.
Earlier this week I called the county clerk regarding my court date on 4-15-05. They don't even have it in the system yet. I'm wondering if the D.A. is even going to take the case?

Yeah, CA is no joke these days. It's becoming very "unfun" to be a car enthusiast around here. The wife and I are actually considering a move out of state. I can't even imagine what it would be like to not stress about smog laws :D There's no place as strict as CA.

Sorry to hear about your troubles Larry - it's pretty shitty. Unfortunately, we all get grouped in with the F&F crowd these days. It's only going to get worse before it gets better.

Yeah, you're probably right. We have hollywood and ricers to thank for that though. Vettes and Porsches aren't usually the choice of ricers.

I have a perfect driving record. No tickets, no accidents. I've been pulled over for speeding before, but this is the first time anything like this has ever happend to me.
Well, here's an update on some serious bullsh!t.

Went to the county court house like my citation says. I check in with the clerk. They have nothing for me... no case... no charges... nothing. She says call back in a week.
I step outside and call Jason (who was cited too) and I tell him what's up. He calls later. The clerk tells him he has nothing either, but the officer has a year to file the case.
We need to check back regularly and keep our eyes open for a notice in the mail.

The report was probably sent to the DA, and after reviewing your driving record he realized the cop was a moron. Contact the DA's office about it. If you took off from work for this crap and have already consulted a lawyer about this have HIM contact the DA and inquire why you skipped work for something that was cancled without any notice to you.

I got a letter from the DA yesterday... they are not prosecuting. After reveiwing the case, they said, "the incident involved a lapse of judgment on your part, rather than a genuine desire to commit a criminal act."
Now I just have to get my $300 back from the PD for impounding my car. Under CA law if the case is dropped, the agency that towed the car is liable for the fees.
